Please read our Terms and Conditions carefully before commissioning any service provided by Lasting Touches LLC. Your use of our services is conditioned upon your acceptance of and compliance with these Terms.

By commissioning or using Lasting Touches LLC, you agree and fully accept these Terms and Conditions. We reserve the right to modify these Terms and Conditions at any time.

Booking

An event is ONLY considered “Booked” after the deposit payment (50% deposit or full amount) is made by the due date indicated on the service invoice. All requested quotes/invoices expire 7 Days after it is emailed to the client if not booked. If the client allows quotes/invoices to expire, it is understood that the event date and time will be made available to other clients, and any discount or special promotion applied will be removed.

Payments & Deposits

The deposit is paid at the time of booking as noted above. The initial deposit payment (50% of the total balance or $150 if the service amount is unknown) is a Non-
refundable retainer fee, which reserves the event date and time, and is required if the event is scheduled more than 14 days prior to the event. If your event is booked less
than two weeks, you will be required to pay in full at the time of booking. The remaining balance must be paid no later than 7 days prior to the day of your event, delivery or pick-up.

Payments Accepted – Payments can be made via $Cash App. Our Cash App ID is $Lasting Touches.

Failure to make deposit or payments by the due date or in a timely manner may result in any or all of the following:

1.  Invalidation and removal of any applicable discounts, special promotions, complimentary services, etc.
2. The release of event date and time.
3. Termination of the contract.

 

Rescheduling/Cancellations/Changes

Rescheduling — If the weather or any situation prevents the balloon installation and/or event decor set up from taking place, the client may reschedule their installation at least 72 hours prior to their event without penalty. The client can reschedule their event within the next 365 calendar days, based on the availability of Lasting Touches, without being charged a fee.  You must notify us immediately in order to secure the new date. If the date is not rescheduled or not available, the below cancellation policy and fees will apply.

Cancellation — Client maintains the right to cancel at any time, however, a cancellation fee may apply if we purchased supplies to build your decor, started working on your décor or turned down other work to decorate your event.

If an event is canceled, one of the following cancellation fees applies:

• No (0%) Cancellation Fee for orders canceled MORE than 60 days in advance of the event date.
• 25% Cancellation Fee for orders canceled LESS than 45 days in advance of the event date.
• 50% cancellation fee for orders canceled LESS than 30 days in advance of the event date.
• 75% cancellation fee for orders canceled LESS than 14 days in advance of the event date.

Changes — “Reductions” or “changes” (adding/deleting decor pieces) must be made in writing if done after these terms & conditions have been signed and the invoice has been accepted and a deposit has been paid. Color or design changes can result in additional charges.

Event Set-Up/ Balloon Installations & Delivery

A two-hour minimum is required for any setup on-site. A 3-4 hour minimum access is required for jobs totaling $1,000 or more in the room/venue where the event will take place.

A Delivery & Installation Fee will be added to all orders. Our delivery and installation charge fee depends on the location of the event and the complexity of the set-up. This requires additional working hours, travel time, truck rental, equipment set up, and staff.

Access to the event location must be secured and confirmed by the client to ensure timely setup. Lasting Touches LLC will arrive onsite within the hour of installation time specified. Lasting Touches LLC cannot be held responsible for delays (or incomplete décor) if a reasonable amount of time is not allowed to complete décor services as described in this agreement.

Lasting Touches LLC is only responsible for the decor items and services listed on the final invoice and takes no responsibility for the setup and/or decorations of other decorators/friends, etc., supporting the client's event setup.

Material Guarantee—All materials are guaranteed to be as specified by the manufacturer. If a supplier discontinues a product or manufacturer changes material type, Lasting Touches LLC reserves the right to make any last-minute changes (at our discretion based on the availability of materials at the time of the event). We reserve the right to substitute an item of like kind and quality.

Strike/Removal

A strike/removal/clean-up service fee is charged when we return to breakdown the balloons and/ or decor provided by Lasting Touches and retrieve our equipment, decor items and framework. All embellishments and framework are the property of Lasting Touches LLC and these items will be collected during the breakdown of the event. The customer is fully responsible for providing timely access to the event area for strike and breakdown. Should all equipment and
materials not be available to retrieve from the location, the customer will be responsible for the replacement costs of the missing equipment or material.

A Removal/Strike fee is not charged if handled by the client. The client will be responsible for returning to us our equipment within 5 days after the event.

The client is responsible for all losses due to theft, vandalism, misplacement or damage. In the event that our equipment is damaged, misplaced, or stolen, the Client agrees to be billed for the repair or replacement cost of the item(s).

Indoor Events- Balloons

We use only the highest quality products and make every possible effort to ensure that your décor will meet or exceed your expectations.  However, due to the nature of balloons, we cannot guarantee that your balloons will remain perfect and intact when used indoors if the humidity and temperature changes in a room fluctuate
due to AC or heating changes and/or outside temperature changes from open windows or doors. Extremely cool temperatures can cause balloons to deflate, humidity can cause balloons to oxide and if the room is too warm/hot, balloons can expand and possibly pop.

Outdoor Events-Balloons

As mentioned above, due to the nature of balloons, we cannot guarantee that your balloons will remain perfect and intact especially when used outdoors.  Some balloons will occasionally deflate sooner than expected and will also be adversely affected by wind, rain, rough handling, extreme heat and other uncontrollable factors.

All outdoor performances must be conducted in a safe manner, and there must be an indoor rain contingency plan. In the event of cancellation without such a contingency, the customer agrees to compensate Lasting Touches LLC with the full payment.

Helium Balloons Outdoors—To get the best use out of Helium-filled designs including bouquets/clusters, arches centerpieces, etc. we strongly recommend that you use them for INDOOR ONLY. Unfortunately, their nature, behavior, and movement are very unpredictable and they are likely to flop around in the wind, lose their form, deflate or pop.

Sun Damage—On the off chance that the sun is shining bright enough to cause any damage, it’s worth noting that if left in the sun, the balloon can start to fade. If it’s super hot, then be sure to know the balloon may pop.

Safety Warnings

Balloons can cause a choking hazard and once the balloons have been delivered, Lasting Touches LLC no longer accepts any liability, children should be monitored to ensure they do not suck helium or swallow balloon particles. Balloons in swimming pools can damage the filter system and Lasting Touches LLC does not assume
any responsibility for pool equipment if damaged.

Disclaimer: We use professional equipment and material as intended for its particular purpose within all designs. To limit your risk of damage we recommend that all decor and items remain in the position and location they are ordered for, installed in or placed in. Please do not use or place any decor designed for indoor use outdoor or outside of covered 4-wall framed structures.
